Terms of Service

1. Provider and scope

The provider is Jan Meier, Hulmenweg 82, 8352 Ricketwil (Winterthur), Switzerland (email: jan.hulmenhof@hotmail.com, phone: 079 413 13 63). These Terms of Service apply to registration and use of OfferPilot as well as to all subscriptions and one-time purchases concluded through it.

2. Account and formation of contract

OfferPilot may be used by private individuals as well as by people and businesses acting in a commercial or professional capacity. Registration requires that you are at least 18 years old and have legal capacity. When using OfferPilot on behalf of a business, you confirm that you are authorised to enter into contracts for that business.

Registering a free account does not trigger a subscription or a payment. A paid contract is only formed once you see the product, price, and renewal terms during the order process, actively accept these Terms of Service, and complete the order via Stripe. You will then receive an electronic confirmation. Account details must be accurate and up to date; login credentials must not be shared with unauthorised persons.

3. Services and usage limits

OfferPilot supports the creation, editing, approval, and sending of quotes, invoices, and contracts. The free account includes 2 documents as a one-time allowance. Starter includes up to 8, Standard up to 30 documents per calendar month; Professional has no document quantity limit. Unused monthly allowances are not carried over. In addition, to protect the service, a maximum of 20 AI requests per 24 hours applies without an active subscription and 60 with an active subscription. One-time purchased document credits do not expire. Abusive, unlawful, or security-threatening use is prohibited.

4. AI content and responsibility

AI output can be incomplete or incorrect and does not replace legal, tax, or professional advice. You review content, prices, recipients, and attachments before sending and are responsible for the lawfulness of the data you enter and send. OfferPilot may block or remove clearly unlawful content.

5. Prices, payment, and setup

The final prices in Swiss francs shown before conclusion on the pricing page and in the Stripe checkout apply. OfferPilot is currently not subject to VAT; no value-added tax is charged. Subscriptions are billed monthly in advance via Stripe. Document credits and a chosen personal setup are one-time purchases. Self-service setup is free; personal setup costs a one-time fee of CHF 25.

6. Professional trial and renewal

The Professional trial lasts 30 days and includes at most 20 documents. A payment method is required to start, but nothing is charged during the trial. Without cancellation, the subscription then automatically renews each month at the price shown at the time of conclusion (currently CHF 49.99 per month). The trial can only be used once per account and person.

7. Term, cancellation, and refunds

Subscriptions can be cancelled monthly. Cancellation is done in the account via the Stripe customer portal and takes effect at the end of the current billing period. Access remains active until then.

Refunds: No pro-rata refund is issued for the current, already paid billing period – the cancellation takes effect only for the future, not retroactively. This also applies if you cancel within a period or stop using the account. One-time purchased, unused document credits do not expire and remain available after a subscription is cancelled. Swiss law does not provide a general statutory right of withdrawal for ordinary online purchases. Mandatory statutory claims, in particular for an incorrect charge or a service not rendered as agreed, remain unaffected; in such a case, please contact us at the email address given in the contact details.

8. Data processing on behalf

To the extent you process personal data of your customers in OfferPilot, you act as the controller and OfferPilot as the processor. OfferPilot processes this data only for the agreed features, protects it appropriately, obliges any persons involved to confidentiality, and uses the sub-processors named in the privacy policy. The supplementary Data Processing Agreement forms part of these Terms of Service to the extent you have personal data processed on your behalf. OfferPilot supports you within a reasonable scope with data subject requests and security incidents. After the contract ends, data is deleted or handed over on request, unless statutory obligations prevent this. You ensure that you are legally permitted to transmit the data to OfferPilot.

9. Availability and liability

OfferPilot strives for reliable operation but does not owe uninterrupted availability. Unlimited liability applies for damages caused intentionally or through gross negligence, as well as for liability that may not be excluded by law. Otherwise, liability, to the extent legally permitted, is limited to foreseeable direct damages and the amount paid in the last twelve months. No limitation applies where mandatory law requires otherwise.

10. Changes

Changes with material disadvantages for existing paid contracts will be announced in good time by email and apply at the earliest for a following billing period. If the change is not merely technical or legally required, you may cancel before it takes effect. For new contracts, the version shown at the time of conclusion applies.

11. Governing law and jurisdiction

Swiss law applies. The place of jurisdiction is, to the extent legally permitted, the provider’s registered seat. Mandatory places of jurisdiction, in particular for consumers, remain reserved.
